Health Department inspections — October 2026: two general-category items open, no enforcement action

What the Health Department’s record says

The Department’s annual inspections this autumn — preschool (permit 6220) on 2 October 2026 and infant/toddler (permit 6447) on 9 October 2026 — both ended “Initial Annual Inspection - Reinspection Not Required,” with items in the Department’s lowest category recorded OPEN as of 17 October 2026:

• Preschool, 2 October — Section 47.33(c)(1) — general violation. Register wording: “Staff and volunteers obtain documentation showing immunization with 2 doses measles/mumps, 1 dose rubella, 2 doses varicella and 1 dose Tdap. Medical exemptions only. History of measles, mumps or rubella shall Not replace MMR vaccine except in presence of MMR varicella antibodies.” — recorded OPEN.
• Infant/toddler, 9 October — Section 47.13(f) — general violation. Register wording: “Child care service teaching staff acting as assistant teachers do Not meet age and educational requirements.” — recorded OPEN.
• Infant/toddler, 9 October — Section 47.33(c)(1) — general violation. Same immunisation-documentation wording as above — recorded OPEN.

A non-routine monitoring inspection of the preschool on 6 October 2026 passed with no violations. No summons was issued (“Reinspection Not Required” carries no fine), both permits are active (preschool to 8 March 2028, capacity 122; infant/toddler to 20 March 2027, capacity 45), and the school is open and permitted. Tribunal record, refreshed 17 October 2026: four decided cases since 2019 — two sustained, two dismissed, $200 in penalties — summarised above.

What this means & what parents should know

General violations are the Department’s lowest category — records and qualification items that are checked again at the next routine inspection rather than enforced with a summons. A public-health hazard is the Department’s most serious category and must be corrected immediately; a critical violation must be corrected within two weeks; a general violation is the lowest category and is re-checked at the next routine inspection.

• Staff immunisation records (47.33(c)(1)) — both programmes: the school must hold documentation that every staff member and volunteer is immunised against measles, mumps, rubella, varicella and Tdap; the inspector recorded that this documentation was incomplete.
• Assistant-teacher qualifications (47.13(f)) — infant/toddler: staff working as assistant teachers must meet the Health Code’s minimum age and education requirements; the inspector recorded that this requirement was not met. The register does not say how many staff or which requirement.

What happens next. The items stay on the register until an inspector records them corrected, normally at the next visit; we will update this notice when that happens. Worth asking the school: whether the immunisation files are now complete and which assistant-teacher qualification was at issue. These items are the Department’s allegations and are not adjudicated: no summons was issued, and the school may contest any citation.
